Terms and Conditions of Web Site Use

1. CARJOCKEY.COM PROVIDES THE VENUE AND AN INTERACTIVE ONLINE SERVICE "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. All conditions of sale and any warranty expressed or implied in the description of the vehicle is the sole responsibility of the particular seller.
2. Users agree to indemnify and hold CarJockey.com harmless with regard to loss or damage experienced through their use of this system.
3. CarJockey.com reserves the right to refuse service to anyone at any time.
4. All Registration Information is kept confidential.
5. In the event that you have a dispute, you release CarJockey.com (and our agents and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
6. Any notices to CarJockey shall be given in writing to 2626 West Parrish Ave, PMB 285, Owensboro KY, 42301, or by email to service@carjockey.com, or to the address you provide to CarJockey.com in the registration process. Notice shall be deemed given 24 hours after email is sent (unless the sending party is notified the email address is invalid) or 48 hours after delivery of notice to CarJockey mail box. Alternatively, CarJockey.com may give you notice by certified mail, postage prepaid, and return receipt requested, to the address provided to CarJockey.com during registration. In such case, notice shall be given 3 days after the date of mailing.
7. User information includes any information provided to CarJockey.com or other users during the registration, listing process, or purchase process.
8. The user is solely responsible for all information provided to CarJockey.com or other users period. CarJockey.com acts as a passive conduit for the online distribution of vehicle sales information. However CarJockey.com may take any action with respect to such information it deems necessary or appropriate in its sole discretion if it believes the information may create any liability for CarJockey.com.
9. This Agreement shall be governed in all respects by the laws of the State of Kentucky. CarJockey.com does not guarantee continous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. The failure of CarJockey.com to act with any default by user does not wave the right to act with respect to subsequent or similar defaults. This initial kept agreement set forth the entire understanding and agreement between CarJockey.com and all users with respect to the subject matter hereof.
